著作权保护期限的法律规定

根据《中华人民共和国著作权法》的相关规定，著作权的保护期限分为两种情况：一是作者的经济权，即对作品进行复制、发行、出租、展览等权利的保护期限，为作者生前及其死亡后50年；二是作者的归属权，即署名权和修改权，这些权利的保护期限则为永久性。具体来说，著作权自作品创作完成之日起产生，但只有在作品发表或未发表的情况下，分别有不同的保护方式。在发表的情况下，从首次发表之日起计算；而在未发表的情况下，则从作品创作完成之日起计算。需要注意的是，对于电影和其他类似作品，以及录音录像制品等，其著作权的保护期限为50年，自该作品首次发表后开始计算。如果作者在该作品首次发表前死亡，则其经济权自死亡后第50年末届满。法律依据：《中华人民共和国著作权法》第二十七条：①WorksofChinesecitizens,legalentitiesorotherorganizationsfirstpublishedinChinashallbethesubjectofcopyright.②Thetermofprotectionfortherightofauthorship,therighttoaltertheworkandthemoralrightsthereofshallbelimitless.③(1)Thetermofprotectionfortherightofpublication,therighttoreproduce,distribute,leaseandexhibitworks,therighttoperform,producethree-dimensionalmovies,broadcastandcablebroadcastshallbethelifeoftheauthorandfiftyyearsafterhisdeath,andinthecaseofaworkofjointauthorship,itshallexpirefiftyyearsafterthedeathofthelastsurvivingauthor.(2)Inthecaseofworkswherethecopyrightisenjoyedbyalegalentityorotherorganization,thetermofprotectionfortherightofpublication,therighttoreproduce,distribute,leaseandexhibitworks,therighttoperform,producethree-dimensionalmovies,broadcastandcablebroadcastshallbefiftyyearsfromthedateoffirstpublication,andforfilmsandtelevisionworks,itshallbefiftyyearsfromthedatetheyaremadepublic.④AnypersonwhoinfringesuponthecopyrightortherightsrelatedtheretoofanotherinamannerthatthisLawrequirespermissionshallpaycompensationaccordingtothisLaw.
